okay, this sucks.
is the recall postponed or not?
a fucked up situation for any California political consultants planning on spending the next month in Vietnam.
do i cut the checks for the TV and radio buys? do i print the hundreds of thousands of mailpieces with "VOTE sept 16" on them? do i continue spending money phoning absentee voters?
dammit.
if you didn't already know, the recall election may be postponed, unless of course the Supremes decide to allow it to continue.
that would be a huge display of situational ethics, or situational constitutional law, since the entire 9th circuit decision postponing the election is rooted in bush v. gore and the equal protection clause.
but since bush v. gore is hardly about protecting the right to vote (as opposed to protecting scalia's shot at chief justice) the Supremes may very well rip off the mask of impartiality and just declare themselves tools of the GOP.
the recall is losing steam, and may very well not pass if held in oct. but if it goes to march, it is dead. ahhnold will continue to implode as more stories about his manhandling and lies surface and reep voters are whipped into a pro-life frenzy during a primary election (killing pro-choice arnold).
so in the interest of perhaps handing the election to the reeps, the Supremes may overrule the 9th circuit.
of course, that would only emphasize the illegitimacy of the bush presidency at a faltering point for 43 (as the partisan accusations against bush v. gore are revived) and damage him significantly going into the 2004 race.
so scalia may have to call a hit on rehnquist before nov. 2004.
or they can just stick with their own precedent and refuse to hear the recall case.
